  5. This binary code license ("License") contains rights and restrictions
  6. associated with the use of the accompanying Rumora Automatisering 
  7. en Advies ("RAA") SQL Plug-In software and documentation ("Software").
  8. Read the License carefully before using the Software. By using the 
  9. Software you agree to the terms and conditions of this License.
  10.  
  11. 1.      License to Use. Licensee is granted a right to use this Software
  12. and agrees to indemnify, hold harmless, and defend RAA and its licensors 
  13. from and against any and all claims or lawsuits, including attorneys' fees, that 
  14. arise or result from the use or distribution of Software.
  15.  
  16. 2.      Restrictions. Software is confidential copyrighted information
  17. of RAA and title to all copies is retained by RAA and/or its licensors.
  18. Licensee shall not decompile, disassemble, decrypt, extract, or
  19. otherwise reverse engineer Software. Software may not be leased,
  20. assigned, or sublicensed, in whole or in part. Software is not designed 
  21. or intended for use in online control of aircraft, air traffic, aircraft
  22. navigation or aircraft communications; or in the design, construction, 
  23. operation or maintenance of any nuclear facility.  Licensee warrants that
  24. it will not use or redistribute the Software for such purposes.

  26. 3.      Trademarks and Logos. This License does not authorize Licensee
  27. to use any RAA name, trademark or logo.

  29. 4.         Disclaimer of Warranty. Software is provided "AS IS," without a
  30. warranty of any kind. ALL EXPRESS OR IMPLIED REPRESENTATIONS AND
  31. WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY,
  32. FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, ARE HEREBY
  33. EXCLUDED.

  35. 5.      Limitation of Liability. RAA AND ITS LICENSORS SHALL NOT BE
  36. LIABLE FOR ANY DAMAGES SUFFERED BY LICENSEE OR ANY THIRD PARTY AS A
  37. RESULT OF USING OR DISTRIBUTING SOFTWARE. IN NO EVENT WILL RAA OR ITS
  38. LICENSORS BE LIABLE FOR ANY LOST REVENUE, PROFIT OR DATA, OR FOR
  39. DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE
  40. DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY,
  41. ARISING OUT OF THE USE OF OR INABILITY TO USE SOFTWARE, EVEN IF RAA HAS
  42. BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  44. 6.     Governing Law. Any action related to this License will be  governed by 
  45. Dutch law . No choice of law rules of any other jurisdiction will apply.

  47. 7.     Severability. If any of the above provisions are held to be in
  48. violation of applicable law, void, or unenforceable in any
  49. jurisdiction, then such provisions are herewith waived or amended to
  50. the extent necessary for the License to be otherwise enforceable in
  51. such jurisdiction.   However, if in RAA's opinion deletion or amendment
  52. of any provisions of the License by operation of this paragraph
  53. unreasonably compromises the rights or increase the liabilities of RAA
  54. or its licensors, RAA reserves the right to terminate the License.
  55.  
  56. 8.    Error proneness. The License is granted as is. 
  57. Licensees are aware that Software may not be fault tolerant and any 
  58. damages as a result of errors are for Licensees risk only.
